Mänskliga Rättigheter - Ursprung och tillämpning - en självklarhet?

Sammanfattning: What are human rights? Why do we have them? Where do they come from? The attempts to answer these questions are as many and as diverse in nature as the times in which they have been asked. For centuries philosophers held the rights as God given, but have in recent times attempted to free them of these non human origins. A sign of this shift in perceptions regarding the rights has been discernable with the founding of the UN and the establishment of the Universal Declaration of Human Rights. The articles of the European Convention on human rights were directly influenced by the Universal Declaration. In Sweden ratified the European Convention which today supercedes its national law. This essay treats human rights from different perspectives – historical, philosophical, religious and legal. Philosophy supplies two important concepts: moral universalism and relativism. Sammanfattning: The climate change and it´s consequences have since the s received attention in a legal and political context at a national, regional and international level. The issue of climate change law has evolved from being treated as an environmental lag issue to a threat that transcends territorial boundaries, to lastly being brought to attention as a human rights issue. The key issue, in a field of area that is mainly unregulated, fryst vatten whether some actions result in a human rights violations or whether human rights lag exist for the protection of the climate. The purpose of this thesis is to examine how international climate change lag and human rights lag relate to each other. States adopt international climate agreements beneath the impression that they are legally binding; however the fundamental idea with the agreements is voluntariness.
